These terms govern your use of the Transparency website and application, provided by dfacto.ai. By downloading or using the software you accept them.
The service
Transparency is software you run on your own Mac. It controls per-application window opacity by driving yabai, a separate, independent open-source project that we do not own, control, or provide.
Requirements you must understand before buying
The application cannot function without yabai and its scripting addition, which requires System Integrity Protection to be partially disabled on your machine. That is a decision with security consequences that only you can make, and it is stated plainly on the documentation page before purchase.
We are not responsible for the behaviour of yabai, for changes Apple makes that break it, or for consequences of your decision to modify your machine's security settings.
Purchases
Licences are sold through a merchant of record who is the seller of record for your transaction and whose terms also apply to the payment itself. Licences are one-time purchases, not subscriptions; nothing recurring is charged. Prices are shown before purchase and may change for future purchases, never retroactively.
Refunds are covered by our refund policy. Licence terms are in the end-user licence agreement.
Acceptable use
You agree not to:
- redistribute, resell, or sublicense the software or your licence key;
- attempt to forge, tamper with, or circumvent licence verification;
- use the software unlawfully or to infringe someone else's rights.
Availability
The website may be unavailable at times. The application is unaffected by this: it runs locally and verifies its licence offline, so an outage on our side cannot disable software you have already installed. That is a deliberate design choice, not a promise about uptime.
Warranty and liability
The software is provided “as is”, without warranty of any kind to the fullest extent permitted by law. Our total liability for any claim relating to the software is limited to the amount you paid for it in the twelve months before the claim.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
Termination
You may stop using the software at any time. We may terminate a licence for material breach of these terms or the licence agreement, having given you notice and a reasonable chance to put it right where the breach can be remedied.
Governing law
These terms are governed by the laws of India, without regard to conflict-of-law rules. If you are a consumer resident elsewhere, you keep the protection of the mandatory consumer law of your country of residence.
